NOTICE IS HEREBY GIVEN THAT THE SEABROOK CITY COUNCIL WILL MEET ON TUESDAY OCTOBER 1, 2019 AT 6:45 PM IN THE CITY HALL CITY COUNCIL CHAMBERS, 1700 1ST STREET, SEABROOK, TEXAS, TO DISCUSS, CONSIDER, AND IF APPROPRIATE, TAKE ACTION WITH RESPECT TO THE ITEMS LISTED BELOW.

AN ORDINANCE AMENDING ORDINANCE 2018-09, APPROVING AMENDMENTS TO CHESAPEAKE BY II PLANNED UNIT DEVELOPMENT ("PUD"), LOCATED IMMEDIATELY EAST OF REPSDORPH ROAD, SOUTH OF BRUMMERHOP PARK AND NORTH OF LARRABEE STREET, BY REVISING THE PLANNED UNIT DEVELOPMENT ("PUD") PLAN, REGULATIONS, RESTRICTIONS AND CONDITIONS, EXHIBIT B ("PLAN") ONLY IN RELATION TO THE "DEVELOPMENT REGULATIONS, MAXIMUM HEIGHT OF STRUCTURES", LIMITING STRUCTURES LOCATED WITHIN PHASE 4 OF THE ("PLAN") TO 3 STORIES, BUT ADDING A NEW SUBSECTION "(C)" TO ALLOW AN EXCEPTION INCREASING ELEVATION TO NOT MORE THAN 55 FEET ABOVE GROUND LEVEL, MEASURED FROM FINISHED GROUND ELEVATION TO MEAN ROOF HEIGHT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; PROVIDING FOR A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF BY INCLUSION INTO THE CODE; AND PROVIDING FOR SEVERABILITY AND NOTICE

Four separate motions are required:  1) to approve a tax rate of $40.3139 cents per $100 valuation of assessed property for operations and maintenance;  2) to approve a tax rate of $14.8844 cents per $100 valuation of assessed property for the interest and sinking fund;  3) to approve property tax rate increase by the adoption of a tax rate of $55.1983 cents per $100 valuation, which is effectively a 6.49 percent increase in the tax rate; and 4) to approve Proposed Ordinance 2019-26, "Tax Ordinance" on first and final reading with the reading of the caption serving as the reading of the ordinance and requiring a record vote.

AN ORDINANCE FIXING AND LEVYING MUNICIPAL AD VALOREM TAXES FOR THE CITY OF SEABROOK, TEXAS FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2020 AND DIRECTING THE ASSESSMENT AND COLLECTION THEREOF

4.3 Consider and take all appropriate action on the appointment of an Alternate Municipal Court Judge for a term to expire June 7, 2021. Municipal Court Judge Dick Gregg, III has nominated Kathleen McCumber for this appointment. (Council)

THE CITY COUNCIL RESERVES THE RIGHT TO HEAR ANY OF THE ABOVE DESCRIBED AGENDA ITEMS THAT QUALIFY FOR AN EXECUTIVE SESSION IN AN EXECUTIVE SESSION BY PUBLICLY ANNOUNCING THE APPLICABLE SECTION NUMBER OF THE OPEN MEETINGS ACT, (CHAPTER 551 OF THE TEXAS GOVERNMENT CODE) THAT JUSTIFIES EXECUTIVE SESSION TREATMENT.
